TERMS OF USE – FREE EDITION
Hackerrangers.com, Hackerrangers.net, and all of their domains are owned and operated by PERALLIS CONSULTORIA E CAPACITAÇÃO EM TI LTDA (“Hacker Rangers”). Access to or use of the platform, and any information, material, data, products, services, and other materials made available on or through it, are subject to these terms and conditions and all applicable laws. For purposes of these terms, “Service” means the service established in the Proposal in connection with the licensing of the Hacker Rangers platform (“Platform”) and its functionalities, and “User” means the individual or legal entity that accesses or uses the Service, subject to the conditions applicable to the modality being used.
Access to and use of the information, materials, data, products, services, and other content made available on the Platform are authorized exclusively for the purposes provided for in the Service and in accordance with the functionalities and limitations applicable to the Free Edition. The User may not use, reproduce, distribute, share, disclose, or make available to third parties, publicly or privately, screenshots, downloads, or any other forms of copying, duplication, or replication of the Platform, its products, services, documents, content, or related materials, except when expressly authorized by Hacker Rangers or when such sharing is part of the functionalities made available by the Service itself.
The Free Edition is provided free of charge, in accordance with the conditions and limitations presented by Hacker Rangers at the time of use. Certain functionalities, features, usage volumes, or access conditions may differ from those offered in paid versions of the Service. Access to the Free Edition will be provided for an indefinite period, without this representing a guarantee of permanent availability, continuity, or maintenance of the same functionalities, limits, or conditions of use. The free provision of the Free Edition does not grant the User any expectation or vested right to the continuation of the modality, its functionalities, limits, or conditions of use.
Hacker Rangers may periodically update these Terms of Use, including to reflect changes to the Free Edition, the Platform, its functionalities, and technical, operational, commercial, security, legal, or regulatory requirements. The current version will be made available on the Platform or through Hacker Rangers’ official channels. Materially significant changes will be communicated through reasonable means when required by applicable law.
By accessing or using Hacker Rangers Free Edition, the User declares that they have read, understood, and agreed to these Terms of Use and Hacker Rangers’ Privacy Policy. If the User does not agree with any provision of these Terms of Use or the Privacy Policy, they must immediately discontinue access to and use of Hacker Rangers Free Edition. Continued access to or use of the Platform after these Terms of Use have been made available or updated will be deemed acknowledgment and acceptance of their provisions, subject to applicable legal requirements.
The User may stop using the Free Edition at any time and, when this functionality is available, request termination of their account or instance, subject to the provisions of these Terms, the Privacy Policy, and applicable legal obligations regarding data retention.
GENERAL CONDITIONS OF USE
The obligations of the Platform User are:
a) to adopt appropriate measures to ensure the confidentiality and security of the access credentials to their account, being responsible for use made through such credentials;
b) to appoint one or more administrators to manage the instance, who must have the necessary permissions to access, manage, and, when applicable, modify the data and settings available on the Platform;
c) to ensure that all activities carried out through the account, instance, and Platform comply with these Terms of Use and applicable law;
d) to ensure that authorized users accessing the Platform use the Service in accordance with these Terms of Use, adopting, when necessary, corrective measures, access restrictions, or other actions to ensure proper use;
e) to comply with the limits on users, functionalities, storage, usage, and other conditions applicable to the Free Edition, refraining from adopting mechanisms or practices intended to circumvent or artificially expand such limitations;
f) to provide true, complete, and up-to-date information when necessary for the creation, administration, or use of the account or instance.
In the event of loss or compromise of administrator credentials, or suspected unauthorized access to or use of the account, the User may use the access recovery mechanisms made available on the Platform.
The User is responsible for activities carried out through their account and instance, including those performed by administrators and other users to whom they have granted access, without prejudice to liabilities that cannot be attributed to the User under applicable law.
Hacker Rangers may perform corrective, preventive, evolutionary, or security maintenance on the Platform, as well as implement technical, operational, or functional changes necessary for the continuity, security, stability, or improvement of the Service. Such interventions may result in temporary unavailability, modification, or suspension of functionalities and, when necessary or urgent, may be performed without prior notice. Hacker Rangers may also modify the functionalities, limits, requirements, characteristics, and other conditions applicable to the Free Edition, subject to these Terms and applicable law.
AVAILABILITY, SUPPORT, AND SERVICE LEVEL
The Free Edition is provided subject to Platform availability and does not include any guarantee of a minimum service level (SLA), availability, capacity, performance, response time, continuity, or recovery, unless expressly provided by Hacker Rangers in a specific instrument.
Hacker Rangers may perform interruptions, maintenance, updates, and changes to the Platform that temporarily affect the availability or operation of the Free Edition, including without prior notice when necessary for technical, operational, security, emergency, or legal-compliance reasons.
Unless otherwise expressly stated by Hacker Rangers, provision of the Free Edition does not include an obligation to provide technical support within a specified timeframe, training, implementation, customization, consulting, or any other professional services. Hacker Rangers may, at its discretion, make support channels, materials, or resources available to Free Edition users, without this creating an obligation to permanently maintain such resources or provide a particular level of support.
INACTIVITY AND DELETION OF THE INSTANCE
Hacker Rangers may suspend, restrict, or terminate a User’s or an instance’s access to the Free Edition in cases including:
a) violation of these Terms of Use or policies applicable to the Platform;
b) unlawful, abusive, fraudulent, or use incompatible with the purpose of the Service;
c) attempts to circumvent technical, operational, or commercial limitations of the Free Edition;
d) risk or threat to the security, integrity, availability, or operation of the Platform, its systems, other users, or third parties;
e) use that may create liability, harm, or material risk to Hacker Rangers or third parties;
f) judicial or administrative order, or legal or regulatory obligation; or
g) other situations in which suspension or termination is reasonably necessary to protect the Platform, Hacker Rangers, its users, or third parties.
When the nature and severity of the situation permit, Hacker Rangers may notify the Instance Holder before suspension or termination and, when applicable, grant a reasonable period for correction. In urgent situations involving security, fraud, illegality, risk to the Platform or third parties, or when required by a competent authority, suspension or restriction may occur immediately, subject to applicable law.
Regardless of the circumstances above, because the Free Edition is a free modality provided for an indefinite period, Hacker Rangers may decide to discontinue the Free Edition, in whole or in part, or cease offering it, subject to these Terms and applicable law.
When termination or discontinuation results in deletion of the instance and when technically and legally possible, Hacker Rangers may provide a period for the User to take the actions indicated in the notice, including, when available, exporting data that the Platform allows to be extracted.
For purposes of these Terms, a Hacker Rangers Free Edition instance will be considered inactive if it remains for a period exceeding three (3) months without any relevant activity involving use or administration of the Platform.
For purposes of this provision, relevant activity means performing Platform administration actions through an authorized user, including, as applicable, accessing the instance, managing users, creating, updating, or using functionalities, and adding, modifying, or viewing data.
Instances that remain inactive for more than three (3) months may be deleted by Hacker Rangers, including the data stored therein, subject to applicable legal obligations regarding data retention, protection, and deletion, upon prior notice.
The notice will be considered valid when sent to the email address registered as the administrator in the Platform for the person responsible for or administrator of the instance. The User is responsible for keeping their contact information up to date. From the date the notice is sent, the User will have thirty (30) days to access the instance and resume its use or, when made available by the Platform, export the data available for extraction. After the thirty (30)-day period, Hacker Rangers may permanently delete the instance and the data stored therein.
Deletion of the instance will not affect the retention of information that Hacker Rangers is required to maintain due to a legal or regulatory obligation, the exercise of legal rights, or another legally applicable circumstance. After the applicable retention periods expire, such information will be deleted or anonymized, as applicable.
Hacker Rangers will not be required to retain copies of data from deleted instances after the applicable retention periods have expired, except in circumstances provided for by law or necessary for the exercise of its legal rights.
DATA OWNERSHIP
The User owns all data, information, and content created and stored by the User on the Platform. Except where expressly permitted, Hacker Rangers is not authorized to use, reproduce, adapt, modify, publish, or distribute User data or content for any purpose incompatible with the exclusive purpose of providing the contracted Service during its term.
All trademarks, logos, service marks, symbols, content, trade dress, and all materials provided on or through the Platform by Hacker Rangers are its exclusive property, and their use or display in any manner other than as established herein is prohibited without express authorization.
All native materials displayed on the Platform are the exclusive property of Hacker Rangers, and their use, display, or download without express authorization is prohibited. The publication, display, or other public provision of any content shall not constitute a waiver of any right or interest of Hacker Rangers. Except as expressly provided, nothing contained in these Terms of Use shall be construed as granting any license, interest, or right under any copyrights, trademarks, or proprietary rights of Hacker Rangers or any third party. Unless otherwise provided, no content, in whole or in part, may be used, copied, reproduced, distributed or redistributed, published or republished, downloaded, modified, displayed, posted, transmitted, imitated, adapted, translated, or transmitted in any form or by any means without the express consent of Hacker Rangers.
Hacker Rangers may use data related to use of the Platform, including technical and statistical metadata, for purposes of research, analysis, development, improvement, security, and enhancement of the Platform and its services. Whenever the data used allows the identification of individuals, its processing will be carried out in accordance with applicable personal data protection laws and the provisions of Hacker Rangers’ Privacy Policy.
For purposes of research, statistical analysis, development, and improvement of the services, Hacker Rangers may use aggregated, statistical, and/or anonymized information derived from use of the Platform, provided that such information does not allow identification of the User or individuals associated with use of the Service.
Data used for these purposes may include information regarding use of functionalities, access volumes, usage patterns, performance, technical events, security information, and other indicators related to the operation and use of the Platform. The use of aggregated and/or anonymized information for the purposes set forth in this clause may continue after termination or deletion of the instance, provided that such information does not allow identification of the User or individuals.
USE RESTRICTIONS
The Free Edition may establish a maximum limit on users, licenses, or individuals authorized to use certain Platform functionalities. The user or license limit corresponds to the maximum number of individuals who may use the Platform within the respective instance. Successive or rotating use of the same licenses for the purpose of artificially increasing the number of people served by the Service is not permitted.
Replacement of one user by another will be considered legitimate use when resulting from an actual and legitimate change in the organization’s workforce or membership, including termination of employment, permanent leave, or a change in role that creates the need to replace the previously authorized user.
Recurring removal and subsequent replacement of users for the purpose of allowing a number of people greater than the contracted or available limit to access the Platform will not be considered legitimate use.
Hacker Rangers may use technical mechanisms and information related to use of the Platform to verify compliance with the limits applicable to the Free Edition. Identification of use intended to circumvent the limits of the modality may constitute improper use of the Service, subjecting the User to the measures provided for in these Terms of Use.
During use of the Platform, the User is prohibited from:
a) transferring, assigning, sublicensing, commercializing, reselling, renting, or making access to the Platform available to third parties, except when expressly permitted by the functionalities and conditions of the Free Edition;
b) using the Platform or any of its functionalities to provide services to third parties, create products or solutions intended for commercial provision to third parties, or otherwise commercially exploit the Service without prior written authorization from Hacker Rangers;
c) inserting or making available on the Platform links to third-party websites that are used in violation of their respective terms and conditions of use or applicable law;
d) using logos, trademarks, business names, images, or any other third-party intellectual property without proper authorization, including in email templates, content, or materials used for phishing simulations;
e) entering, storing, or transmitting personal, confidential, or protected information belonging to third parties without proper authorization or in violation of applicable law;
f) using the Platform in a manner that may damage, disable, overload, compromise, or impair the Platform, servers, networks, systems, infrastructure, or services of Hacker Rangers or third parties, or interfere with the operation or availability of the Service for other users;
g) reverse engineering, decompiling, disassembling, translating, adapting, or otherwise attempting to obtain or discover the source code, object code, structure, architecture, algorithms, or vulnerabilities of the Platform, except when expressly permitted by applicable law;
h) creating or using a false identity, or using third-party information without authorization, for the purpose of misleading any person regarding the origin of any communication made through the Platform;
i) using mechanisms, scripts, automations, or any other means intended to circumvent, bypass, or artificially expand the limits on users, functionalities, storage, usage volume, or any other restrictions applicable to the Free Edition;
j) using the Platform for unlawful purposes or to transmit, store, or make available content that is unlawful, defamatory, libelous, harassing, threatening, abusive, invasive of privacy, pornographic or obscene, promotes discrimination or violence, or infringes intellectual property rights, personality rights, or any other rights of third parties;
k) inserting or transmitting viruses, malicious code, files, or mechanisms intended to compromise, interrupt, improperly monitor, or obtain unauthorized access to the Platform, Hacker Rangers’ systems, or third-party systems; and
l) using the Platform to test, exploit, or attempt to exploit security vulnerabilities, except when expressly authorized by Hacker Rangers and performed in accordance with the conditions established by Hacker Rangers.
The User is responsible for the content they enter, store, or transmit through the Platform and for activities performed in their instance, and shall be liable for any damages they may cause to third parties or Hacker Rangers as a result of using the Platform in violation of these Terms of Use or applicable law.
The User may not use the Platform, its materials, functionalities, gamification elements, structure, methodology, or characteristics to develop, reproduce, or make available software, products, or technological solutions that substantially reproduce the Platform or its distinctive elements, or that improperly use Hacker Rangers’ intellectual property, confidential information, materials, or resources.
Violation of the provisions of this section may result in the adoption of the measures provided for in these Terms of Use, including, depending on the nature and severity of the conduct, notification to the User, restriction of functionalities, suspension, or termination of the instance, without prejudice to other measures and rights provided by applicable law.
PERSONAL DATA PROTECTION
Hacker Rangers may process personal data arising from use of the Platform in compliance with applicable personal data protection laws. Personal data processing will be carried out in accordance with the purposes, legal bases, data subject rights, and other conditions established in Hacker Rangers’ Privacy Policy, which forms an integral part of and supplements these Terms of Use.
The User acknowledges that, in connection with use of the Platform, personal data belonging to its users, employees, or third parties may be processed when entered or made available on the Platform by the User. The User is responsible for ensuring that such processing is carried out in accordance with applicable law and the conditions set forth in these Terms.
Hacker Rangers will adopt appropriate technical and administrative measures to protect personal data processed through the Platform against unauthorized access and accidental or unlawful destruction, loss, alteration, communication, or any other form of improper or unlawful processing, taking into account the nature of the data and the risks involved.

TERMINATION
Access to Hacker Rangers Free Edition may be terminated by the User at any time by discontinuing use of the Platform, or by Hacker Rangers under the circumstances provided for in these Terms of Use.
